Welcome to Ride Hub. These Terms and Conditions (“Terms”) govern your use of the Ride Hub mobile application (“App”), which provides online mountain bike skills courses and lessons for riders. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account, accessing, or using the Ride Hub App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

2. The Ride Hub Service

Ride Hub provides a platform for:

  • Accessing pre-recorded video courses on various mountain bike skills.
  • Booking and participating in live online lessons with certified instructors.
  • Tracking your progress through courses.
  • Engaging with other users and instructors through community connection features.

3. User Responsibilities and Acknowledgement of Risk

Mountain biking is an inherently dangerous sport with a risk of serious injury or death. By using Ride Hub, you acknowledge and agree to the following:

  • Assumption of Risk: You voluntarily assume all risks associated with mountain biking, including but not limited to falls, collisions, equipment failure, and environmental hazards.
  • Safety First: You are solely responsible for your own safety and for exercising sound judgment while riding. Ride Hub’s content is for educational purposes only and does not replace the need for professional, in-person instruction or your own assessment of trail conditions and your personal abilities.
  • Physical Fitness: You attest that you are in good physical condition and have no known medical conditions that would prevent you from safely participating in mountain biking. If you have any health concerns, you should consult with a medical professional before engaging in any physical activity.
  • Equipment: You are responsible for ensuring that your bicycle and all related equipment are properly maintained and in safe working order.
  • Local Regulations: You are responsible for knowing and adhering to all local laws, trail rules, and regulations in the areas where you ride.

4. User Account

  • Account Creation: To access certain features of the App, you must create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
  • Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Ride Hub will not be liable for any loss or damage arising from your failure to comply with this security obligation.
  • Eligibility: You must be at least 18 years old to use the App. If you are under 18, you may only use the App with the involvement and consent of a parent or guardian.

5. Payments and Subscriptions

  • Courses and Lessons: Access to certain courses or lessons may require a one-time payment or a subscription.
  • Pricing: All prices are listed in Australian Dollars (AUD). Prices are subject to change, and we will notify you of any changes in advance.
  • Payment Processing: All payments are processed through a third-party payment processor. Ride Hub does not store your credit card information.
  • Refunds: All sales are final. We do not offer refunds for digital content or online lessons, except where required by Australian Consumer Law. If you believe you are entitled to a refund under Australian Consumer Law, please contact us.

6. Intellectual Property

  • Ride Hub Content: All content on the App, including but not limited to videos, text, graphics, logos, and software, is the property of Ride Hub or its licencors and is protected by Australian and international copyright laws.
  • License to You: Ride Hub grants you a limited, non-exclusive, non-transferable license to access and view the content for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from the content without our express written permission.
  • User-Generated Content: By posting any content on the App (e.g., comments, photos), you grant Ride Hub a worldwide, perpetual, irrevocable, royalty-free licence to use, reproduce, modify, and display that content in connection with the App and our business.

7. Prohibited Conduct

You agree not to:

  • Use the App for any illegal or unauthorised purpose.
  • Copy, sell, or distribute any content from the App without permission.
  • Harass, abuse, or harm another person or group.
  • Use the App to transmit viruses or other malicious code.
  • Interfere with the security or operation of the App.

8. Disclaimers and Limitation of Liability

  • No Warranty: The App and its content are provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • No Professional Advice: The content provided by Ride Hub is for educational and informational purposes only and does not constitute professional advice. You should consult with an appropriate professional for any specific safety or medical concerns.
  • Limitation of Liability: To the maximum extent permitted by law, Ride Hub, its directors, employees, and agents will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of your use of or inability to use the App, even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless Ride Hub, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

10. Termination

Ride Hub reserves the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the App will cease immediately.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts located in Queensland to resolve any dispute arising out of these Terms or the App.
